&Em: Terms of Service

By creating an account or using &Em, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the app.

&Em is currently in early testing. Features may change, break, or be removed without notice, and this is reflected in the disclaimers below.

• You must be 18 or over. We enforce this when you set a date of birth on your profile.
• You must provide accurate information, including a genuine date of birth and identity for verification.
• You must not have been previously removed from &Em for breaking these terms.
• One account per person.

Before you can post an outing or request to join one, you'll need to verify your identity through Stripe Identity. Verification helps keep the community safer, but it is not a background check and does not guarantee that any user is who they claim to be, or that they don't pose a risk to others. Verification status can only be set by us, following that check. You can't change it yourself.

You keep ownership of the outings, messages, photos, reviews, and anything else you post ("your content"). By posting it, you give us a licence to store, display, and distribute it within the app as needed to run the service, for example showing your outing to other users, or your profile photo next to your messages.

You're responsible for what you post. You confirm that your content:

• Is genuinely yours to share, and doesn't infringe anyone else's rights
• Is accurate: outings you post should be real plans you're actually going to
• Doesn't contain anything illegal, harassing, hateful, sexually explicit, or otherwise inappropriate

You agree not to:

• Harass, threaten, or abuse other users
• Impersonate someone else, or misrepresent your identity, age, or intentions
• Use &Em for commercial solicitation, spam, or to promote another product or service
• Attempt to bypass verification, or help someone else do so
• Scrape, reverse-engineer, or interfere with the app or its data
• Use &Em if you've been removed from it before

We may suspend or remove any account that breaks these terms, with or without notice, depending on severity.

&Em helps you find and arrange real, in-person meetups with other users. We are not present at these meetups and cannot guarantee the conduct, identity, or safety of any user, verified or not.

When meeting anyone through &Em, we strongly encourage you to:

• Meet in a public place, especially for a first meetup
• Tell a friend or family member where you're going and who you're meeting
• Arrange your own transport, and avoid sharing your home address until you're comfortable
• Trust your instincts, and leave any situation that feels wrong

You are solely responsible for your own safety and conduct when using &Em and when meeting other users. To the fullest extent permitted by law, we are not liable for anything that happens during or as a result of a meetup arranged through the app. See the Liability section below.

If something goes wrong, you can report a user, outing, or message through the app. We review reports and may suspend an account as a result. If your account is suspended, you can submit an appeal, which we'll review.

You can add other users to your circle. Circle-only outings are visible to your circle but not the wider app. You're responsible for who you choose to add to your circle.

Some listings on &Em are events posted by venues or organisers rather than by individual users. Where a listing links out to a third-party ticketing site, that purchase is between you and the third party. We're not responsible for it.

Some of these listings use affiliate ticket links: if you buy through one, we receive a small percentage of the sale, which goes towards our running costs. This doesn't affect the price you pay.

&Em, its logo, and the underlying app (excluding your own content) belong to Let Living Lead Ltd. You may not copy, modify, or redistribute any part of the app without our permission.

&Em is provided "as is" during this testing period, without warranties of any kind, including as to availability, accuracy, or fitness for a particular purpose.

To the fullest extent permitted by law, Let Living Lead Ltd is not liable for any indirect, incidental, or consequential loss arising from your use of the app, including loss arising from interactions or meetups with other users. Nothing in these terms limits liability that cannot legally be limited, such as liability for death or personal injury caused by our negligence, or for fraud.

This section in particular needs a solicitor's eye. The exact wording of a liability cap/exclusion needs to be enforceable under UK law and appropriately scoped, not just plausible-sounding.

You can delete your account at any time. We can suspend or terminate your account if you break these terms, or if we reasonably believe you pose a risk to other users.

We may update these terms as &Em develops. We'll let testers know of any material change.

These terms are governed by the laws of England and Wales, and any disputes will be handled by the courts of England and Wales.
